Fujidenolo Solutions Co., Ltd. (hereinafter ‘FDS’) provides various services, primarily around planning and development of systems using medical images (X-rays, etc.) and other information relating to in-hospital diagnosis. We at FDS understand that appropriately handling and protecting personal information collected from all customers, including businesses with which we have business, is an important social responsibility, which is also fundamental to corporate activities. Based on this understanding, we have set forth the following privacy policy, with which our employees have been familiarized. We are committed to contribute to society through corporate activities emphasizing the importance of appropriate personal information protection and legal compliance. 

1. OBTAINING AND USING PERSONAL INFORMATION

FDS will obtain personal information in an appropriate manner, with the purpose of usage thereof clarified, taking into consideration the business operations and corporate scale of FDS. We will appropriately use the personal information we have collected, only within the range of the purpose thereof, and will never use this personal information for other purposes, or disclose the personal information to a third party with the exception of cases with legal basis.

2. LEGAL COMPLIANCE

FDS will clarify and comply with laws relating to protection of personal information, Japanese government-issued guidelines, and other rules.

3. MANAGEMENT AND PROTECTION OF PERSONAL INFORMATION

FDS will strive to strictly manage customer personal information, prevent unauthorized access to personal information and leakage of personal information, counter risks of loss or damage, and to further improve prevention. We will periodically train employees, manage entry/exit to rooms and buildings, and strive to protect all information assets including personal information.

4.RESPONSE TO COMPLAINTS AND INQUIRIES

FDS will appropriately and speedily respond to inquires and complaints regarding personal information, based on rules such as the Private Information Protection Law.

5. CONTINUOUS IMPROVEMENT OF PERSONAL INFORMATION PROTECTION MANAGEMENT STRUCTURE AND FRAMEWORK

FDS will implement corporate-wide efforts to continuously improve internal rules and implementation thereof under our personal information protection management structure.

GDPR Privacy Policy

This Privacy Policy only applies to processing of personal data subject to EU General Data Protection Regulation 2016/679 (“GDPR”). 

1. PURPOSE OF THIS PRIVACY POLICY

This Privacy Policy aims to give you information on the way of processing (including, but not limited to, collection, use, storage, disclosure by transmission) of personal data relating to an identified or identifiable natural person in EU by Fujidenolo Solutions Co., Ltd. (the “Corporation” or “we”) as a data controller or processor.

We will respect the right to privacy of individuals and comply with data protection and privacy related laws and regulations including GDPR.

2. LEGAL GROUNDS FOR LAWFUL PROCESSING OF PERSONAL DATA

We will use personal data only when relevant laws and/or regulations (in particular GDPR) allows us to do so.

When we process personal data, we will rely on at least one of the legal grounds for lawful processing.

We obtain and process the following personal data (“Customer Information”) of a customer or distributor as a controller. (If the customer or distributor is a corporation or other organization, an individual person who is in charge will be subject thereto. The customer, distributor and individual person in charge are hereinafter referred to as the “Customer”.)

(2) Patient Information
For the provision of our services, we obtain and process the following patient’s personal data in accordance with the measures designated by a Customer who is a medical personnel (“Patient Information”). The Customer decides the purpose and measure of processing of the Patient Information as a controller, and we shall not process the Patient Information for our own purposes.

We collect Customer Information directly from the Customer, indirectly from distributors and/or public sources, and collect Patient Information indirectly from the Customer.  

4. SHARING AND DISCLOSING PERSONAL DATA 

We share and disclose personal data to the following third persons in accordance with GDPR for the purpose stipulated in this Privacy Policy:
(1) Customer Information

・Cloud Computing Service Provider who controls the customer information
・Parent company
(2) Patient Information
・Amazon.com (cloud computing service provider)
・Medical personnel or other designated medical personnel who provides Patient Information

We may transfer Patient Information to a data center controlled by Amazon.com located in the following non-EEA regional third countries for storage of Patient Information at Customer’s choice: Japan, United States of America, Singapore, India, Brazil

5. RETENTION PERIOD OF PERSONAL DATA

We will retain Customer Information and Patient Information only to the reasonable extent necessary to archive the purposes for processing personal data. Specific retention periods are decided based on the following considerations: the purpose for obtaining and processing personal data; the nature of personal data; and the necessity of retaining personal data for legal or business reasons.

6. LEGAL RIGHTS OF CUSTOMERS

If certain conditions are satisfied, the Customer may have the following rights in relation to Customer Information.
(a) To request access to Customer Information: the Customer can receive a copy of Customer Information held by us and check the status of lawful processing of such Customer Information.
(b) To request correction of Customer Information: the Customer can correct incomplete or inaccurate relevant Customer Information, however, we may need to verify the accuracy of such new data provided to us.
(c) To request deletion of Customer Information: the Customer can ask us to delete relevant Customer Information if there is no good reason for us to continue to process it. However, for specific legal reasons, we may not be able to comply with the Customer’s request to delete Customer Information.
(d) To make objection on inappropriate processing of Customer Information: the Customer can make an objection on processing of relevant Customer Information.
(e) To request restriction on processing of Customer Information: the Customer can ask us to suspend the processing of Customer Information.
(f) To request the data portability of Customer Information: the Customer can receive relevant Customer Information in a structured, commonly used, and machine-readable format and has the right to transfer that data to another controller without our hindrance.
(g) To withdraw the Customer’s consent to process Customer Information: the Customer can withdraw its consent to process Customer Information. This will not affect the lawfulness of any processing carried out before such withdrawal. If the Customer withdraws his/her consent, we may not be able to provide certain products or services to the Customer. We will advise the Customer if this is the case at the time of such withdrawal by the Customer.

The Customer has the right to make a complaint against the relevant supervisory authority in the member state of the habitual residence of the Customer. However, we would appreciate it if the Customer gives us a chance to deal with Customer’s concerns as the first step prior to the Customer approaching such supervisory authority.

A patient who is a data subject of Patient Information may also have the same rights with respect to Patient Information under paragraph (a)~(g) above, however, we have no rights or obligations to deal with such rights in relation to Patient Information. Please contact the medical personnel who is the controller of Patient Information.

7. USE OF THE INTERNET

With respect to the collection of Customer Information from websites, we use Secure Sockets Layer (SSL) in our website to transfer Customer Information safely by encrypting it. For improvement of our service, we use Google Analytics from Google, Inc., and HubSpot from HubSpot, Inc., to measure our website performance and analyze through text file “Cookies”. Please note that Customer Information, such as IP address, may be collected by Google, Inc., and HubSpot, Inc., when we use Google Analytics and HubSpot. We use Customer Information collected by Google Analytics and HubSpot only for usage analysis of the websites and processing purposes stipulated in Section 2 of this Privacy Policy.

When Customer Information is provided by the Internet (Email), please confirm and acknowledge that a secure transmission is not guaranteed.
*For the avoidance of doubt, a Customer may reject “Cookies” through browser operation; provided however, in that case, part of our website’s functions may not be used.

About handling personal information

Fujidenolo Solutions Co., Ltd. handles personal information by lawful and fair means as described below.

2. PROVIDING PERSONAL INFORMATION TO THIRD PARTIES

FDS will not provide personal information of any person to a third party without the prior consent of said person, with the exception of cases with legal basis. Those providing information of another person to FDS should do so upon having obtained consent of said person.

3. USING AND MANAGING PERSONAL INFORMATION

(1) FDS will strive to maintain the contents of collected personal information so as to be accurate and up-to-date, and will employ organizational, human, physical, and technological safety management means to manage and protect collected personal information by appropriate methods, so as to prevent leakage, loss or damage of personal information, and to achieve all other forms of safe management of personal information.

(2) FDS may not be able to allow customers who do not provide personal information (company name, name of representative, etc.) to use the system development and server operation management business provided by FDS.

(3) If there is insufficient, incorrect, or fraudulent information in the personal information collected by FDS, the person providing said information may not be able to receive services from FDS or may be excluded from consideration for employment.

4. DISCLOSURE/CORRECTION/USAGE TERMINATION/DELETION OF PERSONAL INFORMATION

If a person indicates desire to disclose/correct/terminate usage or the like of personal information of said person, FDS will faithfully handle this request unless under special circumstances. After procedures to disclose/correct/terminate usage or the like of personal information, the personal information collected for personal identification will be shredded and disposed in accordance with FDS’s safety management measures.

5. INTERNET USAGE

Regarding collection of personal information from website, our website uses SSL technology to encrypt and transmit personal information securely. In addition, in this website, we take statistics of our website using Google Analytics of Google, Inc. and HubSpot of HubSpot Japan KK in order to improve services. The analysis may be performed through the text file “Cookie” generated along with this, for this case, part of user information such as IP address may be collected by Google, Inc. and HubSpot Japan KK. We use this information only for the purpose of tracking and analyzing the usage of websites, including ours, generating reports for the website operators, providing advertising in line with the interests of the customers, and providing other services. By using this site, users are deemed to have given permission for such data processing performed by Google, Inc. and HubSpot Japan KK in the manner and purpose described above.
